The plaintiff further claimed in the lawsuit that he did not listen to the radio programs in question and did not hear the publications himself. He claimed that he knew about the publications following inquiries he received from those who listened to the program and brought its content to his attention.
According to the plaintiff's version, following the defamatory publications, Weizmann-Yaar was summoned to the Weizmann-Yaar Investigation Office and was forced to be questioned about the acts embedded in the publications. However, at the end of the investigation, the investigators reached the conclusion that these were false complaints filed by defendants 4 and 5.
In addition, it was claimed that followingthe publications, the plaintiff received many phone calls from people he did not know who made hate, hatred, and insults directed at him. HisFacebook page also posted hate speech.
Theplaintiff claims that he approached defendants 1 and 2 demanding that they present him with and/or provide him with a recorded copy of the radio program in question, but his request was not answered.
The plaintiff petitions in his claim for compensation in the sum of ILS 600,000 for the damages and losses caused to him, according to him, as a result of the defendants' actions. In addition, the plaintiff demands that the court issue an order instructing the defendants to retract their statements and apologize for the publications they made against him on the radio station.
The Motion for Summary Disposal
As stated, the Applicant petitions for the dismissal of the claim against him in limine for a number of reasons:
Lack of cause and/or lack of rivalry - The Applicant argues that the claim should be dismissed in limine due to lack of cause and/or lack of rivalry, since the plaintiff (hereinafter: "the Respondent") filed a claim on the grounds of defamation, but in practice did not show that an act was committed that constitutes defamation, as defined in the Prohibition of Defamation Law, 5725-1965 (hereinafter: the "Prohibition of Defamation Law").
