Apostillization and Execution of Documents for Use Outside Israel

Israeli law demands that when a document is required to be used outside of Israel and is one of the following, it must be made before a notary: verification of a signature of a document, confirmation of the correctness of a copy, the correctness of inventory, a negotiable document and any document or other action when under law it is to be made before a notary public, including under foreign law.

We provide the service for execution of such documents as well as apostillization procedures for validating these documents for outside of Israel . When a document is intended for use outside Israel (e.g., embassy, sale or purchase of real estate or shares outside of Israel, handing over documents for certification or obtaining a certificate outside of Israel, obtaining insurance benefits, etc.), it is important to ascertain whether apostillization is required and if there is doubt, we advise to do the apostillization procedure.

Notary documents are valid only in the country where the notary is authorized. In order to use documents outside the state, a procedure of notarial approval must be performed first in Court, then in the foreign ministry and then in the relevant state embassy. This procedure is a complex and not inexpensive and may take several days (depending on the working hours of the relevant embassy). Such is, for example, is the procedure for sending notarized documents to China (but not to Hong Kong, which is a party to the Apostille Convention).

According to the Hague Convention of 05.10.1961, apostille approval on the documents accompanying notarized approval is sufficient for the target country to recognize as long as it is also a member of the Convention. When the target country is a signatory to the Apostille Convention, the procedure is significantly cheaper and we usually do it within a business day from the date of notarial signing (subject to Courts working on that day). We provide both electronic apostille services (a faster and cheaper procedure when physical documents are not required and a secure electronic document is sufficient) and apostille certification for countries that are not party to the Hague Convention. (Please note that this procedure is significantly more expensive and usually takes many days because instead of an electronic or expedited procedure at the court, we are required to submit the documents first to the court, then to the Ministry of Foreign Affairs, and then to the embassy of the destination country).
