Towards my sister [the applicant]

  1. Since you have transferred to me all the rights that you acquired from our father [...] in the plot [...] and in the block [...] known as Farm No. [...] in the moshav [...] pursuant to an agreement between you of July 7, 1987 (hereinafter: "the Farm"), I irrevocably undertake to you and to your son [the Respondent] as follows (emphasis added - A.S.):
  2. All the rights in the aforementioned farm will receive my daughter [the applicant's daughter's name] ID [...] and your son [the respondent] ID [...] in equal parts to their ownership one hour before my death (emphasis added - A.S.) (God forbid) according to the division of use and rights as follows.
  3. [The applicant's daughter's name] will have the right to use the residence far from the Moshav Road (a two-story building), while [the Respondent] will have the right to use the house close to the Moshav Road (a one-story building).
  • If there is an expropriation from the farm, the expropriation will be divided between our two children in equal parts.
  1. If part of the farm is designated for building lots, or if plots are received outside the farm and in his merit, [the applicant's daughter's name] will receive the first right to a first building lot, while (l) [the respondent] will have the right to a second building lot, and so on.
  2. [Name of the applicant's daughter] and [the respondent] will do all that is necessary with the competent authorities so that the use of the farm will be done by both of them as stated in this undertaking.
  3. The farm will not be sold except with the joint consent of our two children.
  • In the event that a party wishes to sell the farm (by agreement), the surviving party will have an initial right over another buyer to purchase the outgoing party's share at an agreed price, and if not, at a price that will be assessed by an agreed appraiser.
  • The purchase and transfer of my rights in the farm will be made one hour before my death or at a time that I determine. For this purpose, I am depositing an irrevocable notarized power of attorney (emphasis added - A.S.).
