The Controversy

  1. Ali gave the plaintiffs all his rights to the plot, at the rate of 1/12 of it, which constitutes 1,059 square meters, which is in fact his share of the inheritance of his late father, Ali Muhammad Na'amneh. This is the first transaction (hereinafter: the "First Transaction").  At the time this transaction was made, the rights were registered in the name of Ali's late father.

The second deal was between Ali, Together with his two brothers, Mar'i and Hussein, on the one hand, and Mu'taz on the other (Hereinafter: "The Second Deal").  In this transaction, the shares of three of the heirs of the deceased Ali Muhammad Na'amneh, constituting 3/12 of the plot, were sold in an area of 3,187 square meters (Each seller has 1/12 of a piece).

  1. After the second deal, two deals were made between Mu'taz and Said.  The first, in which Mu'taz sold to Sa'id 3/12 of the plot, in an area of 3,187 square meters (hereinafter: the "Third Transaction"), and the other transaction, between Mu'taz and his three cousins, to Sa'id, on the other hand, in which a similar area was sold to Sa'id (hereinafter: the "Fourth Transaction").  The third transaction ended in registration and a warning note was registered in favor of Sa'id for the fourth.
  2. The first transaction, the gift transaction, was on February 15, 2020. The second transaction (sale) was on December 1, 2022 (on the same day the agreement was signed and an irrevocable power of attorney was signed); The third transaction was on February 15, 2023.  An irrevocable power of attorney was signed earlier, on December 3, 2022; The fourth transaction (sale) was on July 1, 2023, when an irrevocable power of attorney was signed on November 30, 2022.

The latest deal, between Saeed and Basel, is late in time and its fate will be decided in accordance with the decision of the competition between the rights.

  1. Legally, Eli does not currently have registered rights to the plot. Sa'id is registered as the owner of 3/12 of the rights in the plot (3,187 square meters), and Mu'taz is registered as the owner of 1/12 of the plot (1,059 square meters).  There are two warning notes regarding Sa'id's ownership rights, a warning note in favor of Basel and Mu'taz ownership rights, one in favor of Sa'id, one in favor of Sa'id, and the other in favor of the plaintiffs, and the other was registered on November 9, 2023, shortly before the lawsuit was filed.  In addition to the warning note registered in favorof Said's and on Mu'taz rights (1,059 square meters), there is also a cautionary note in his favor regarding the shares of the brothers Mustafa, Subhi and Abd al-Hadi, in respect of the fourth transaction.
