In this way, a parallel and compatibility is obtained between the two alternatives proposed by the program contract
(Both types of projects): Regarding the amount of interest – in both types it is calculated only until the end of the execution period.
With regard to the submission of the realization request 18 months after the end of the execution period – in both types there will be a reduction of 2%of the price for each month of delay beyond the 18-month period. As for delays in the execution of construction, for projects of the first type, there will be a reduction of 2% for each month of delay, and for projects of the second type, there will be a reduction of 5% for each month of delay.
Our eyes see that this interpretation gives the contract completeness and creates a reasonable and logical parallel between its parts, a parallel that is completely consistent with the intention and purpose underlying the contract.
- Indeed, the aforementioned clause 6(h)(3) was drafted incorrectly, and this is apparently the appellant, and so the appellant also claims, due to the haste with which the contract was drafted and due to the urgency to terminate it quickly due to the needs of the hour.
However, from all of the above, it seems to me that there is room to interpret the clause in the manner proposed by the appellant and which is required by its reading in light of the context, in light of the contract as a whole, and in light of the purpose underlying it and the background that led to its formulation.
