Mualem further denied that he knew that the plaintiffs had paid higher sums than those recorded in the contracts he had signed.
Claims of Defendant 3, Broker Mr. Shlomo Zerach Dahari
At the beginning of the statement of defense, Mr. Dahari claimed that the claim was time-barred because the transactions were executed during August 2011, while the claim was filed during September 2018, i.e., more than seven years after the date of signing the contracts.
On the merits of the matter, Mr. Dahari claimed that he had been a real estate broker for about 20 years. As for plaintiffs 1-2, it was claimed that the transactions in their case were not brokered by him. Indeed. Mr. Attias came to his office and was interested in the purchase of land, but this conversation did not mature into the signing of transactions brokered by Mr. Dahari.
With regard to plaintiffs 3-7, it was claimed that during 2011 the Goren Hearing Venue Transferor approached Mr. Dahari in order to locate potential purchasers for him for the purpose of purchasing agricultural lands whose rights are registered in the name of Defendant 4, a company owned by Goren Hearing Place. Some time later, Mr. Elia Shimoni, the spouse of plaintiff 7, contacted Mr. Dahari and claimed that he represented a group of purchasers, some of whom were plaintiffs in this lawsuit. At the end of the negotiations, the sale agreements were signed in the office of the transfer of the venue of the Mualem meeting, who represented the members of the group. Mr. Dahari served only as an intermediary in the transactions, had no connection to the plots of land and received nothing of the consideration paid for the transfer of the Goren hearing place, except for brokerage fees for his work. Mr. Dahari reflected to the purchasers the prices he demanded after the transfer of the Goren Discussion Place for the various plots, but he does not know what the consideration was paid by them.
With regard to the claim of plaintiffs 3-7 that it was Mr. Dahari who referred them and the rest of their friends to the transfer of a Mualem hearing in order to represent them in the sale transactions, Mr. Dahari claimed that the members of the class asked for recommendations about a lawyer whose office is located in Ashkelon. Mr. Dahari gave them the names of a number of lawyers with whom he works on a regular basis, and the members of the group chose to move the venue of the hearing to represent them in these transactions.
