Counsel for the plaintiffs claimed in the plaintiffs' summaries that from the beginning of the proceeding, he was "bothered" by the question, as he defined it, whether the transfer of the hearing venue had knowledge of the real sums paid by the plaintiffs (section 79(a) of the summaries). However, counsel for the plaintiffs clearly ignored the fact that none of the plaintiffs claimed that prior to signing the contracts, he had informed the transfer of the venue of the concealed hearing that he was required to record a lower sum in the contract. This, despite the fact that according to the plaintiffs, this was a very surprising demand on Mr. Dahari's part, and that this demand was very distressing to them. As stated, in my opinion, the plaintiffs were careful not to update the transfer of a concealed hearing venue about this, so as not to thwart the signing of the contracts. Any other argument at this time contradicts the plaintiffs' course of action in real time, and arouses discomfort.
For the sake of completeness of the picture, it should be said that in the interrogation of Mr. Moshe Horowitz, he confirmed that all the plaintiffs knew of the demand to register a lower sum in the contracts on the day they came to sign the contracts (p. 484, question 1), "even before they came to the meeting with Mualem" (ibid., question 21). This version explicitly contradicts the version of the other plaintiffs, who claimed that the requirement to register a small sum in the contracts arose "at the time of signing the contract" (paragraph 9 of the affidavit of the transferee). Either way, none of the plaintiffs updated the location of Mualem's hearing on the matter.
Fourth, after the contracts were signed by plaintiffs 3-6 (plaintiff 7 signed the contract later, as will be explained below), plaintiffs 3-6 claimed that they had handed over all the sums they had brought in cash in an envelope to Mr. Elia Shimoni, who served as their representative, and that Mr. Shimoni put all the sums in one envelope and went alone with Mr. Dahari to meet with Mr. Goren, and a few minutes later he again claimed that he had handed over the funds to the transfer of the Goren hearing place (paragraph 14 of Ariel Cohen's affidavit; 14 to the affidavit of Avishai Junger; Paragraph 11 of the affidavit of Benya Sidon; Paragraph 7 of the affidavit of Mr. Moshe Horowitz).
