After Deputy Mayor Cohen acceded to his request and addressed him a letter in accordance with his wishes, Goren enlisted the mediator, who appeared to him to be naïve in various aspects, in order to assist him in carrying out his work, as will be explained below.  Goren provided Mr. Dahari with the letters of the Deputy Mayor, instructing him to locate potential purchasers or to speak with those who had shown interest in the land in the area of the land that is the subject of the lawsuit, and to present them with these letters.  At the same time, Mr. Dahari was prohibited from providing the purchasers with details about the identity of the seller, defendant 4, who is owned by the transferee of the Goren meeting place, and Mr. Dahari was certainly told that the potential purchasers would not be able to meet the Goren meeting place until the date of the signing of the contracts (see, for example, the words of the Goren meeting venue in the recording with Mr. Attias, Appendix N/18, p.  5, paras.  13-18).  In this way, Goren reserved the possibility of claiming in retrospect that he did not make any representation to the purchasers, since he had never met them or spoken with them prior to the purchase of the land parcels.

Goren also instructed Mr. Dahari to ensure that the purchasers would be represented by an attorney on their behalf (paragraph 31(a) of the statement of defense on behalf of defendants 1 and 4).  Goren claimed that he did so in order for the ISA to "explain to him the nature of the transaction and in any case be responsible for him" (ibid., ibid.).  However, even though this directive is bound by reality, since there is an inherent conflict of interest between the fact that Goren is an interested party in the sale of the land and that he is an attorney for the purchaser, in the circumstances of the case I am under the impression that the essence of the directive is intended to create an additional barrier between the transfer of Goren's place of discussion and the purchasers, so that they cannot claim in retrospect that they relied on his representations or on his statements.
