Even if it is possible to assume that the attorneys who appeared in court were fed by others and misled by them, it cannot be assumed to the credit of Saada and Scherzer, who themselves conducted the negotiations with Malka, and denied in court that they had negotiated with him prior to the filing of the indictment – and this, as stated, contrary to the facts that were proven before me.
Completion of an investigation into favors promised to the queen orally
- The decision to complete the investigation was made following information published in the media about allegations raised by Malka in a proceeding against him in the disciplinary court of the Israel Bar Association, regarding additional benefits that were orally promised to him by the Department for the Investigation of Police as part of the state's witness agreement, which were not documented in writing. In addition, it was reported that Saada and an attorney from the Department for the Investigation of Police were summoned to appear in court.
The defense requested an urgent hearing following the media reporting. The hearing took place on April 27, 2022, after which the prosecution sent the defense an email on May 1, 2022, in which it was said that in a refresher conducted for Malka in 2017 prior to his testimony in court, he raised the issue of the promise against him that there would be no objection to his release from prison in a third. It was also reported that in June 2019, the State Attorney's Office who handled Malka's parole board contacted the prosecution and asked to find out whether he had been given any promise regarding the parole board as part of the state's witness agreement. An inquiry conducted with Saada at the time revealed that the queen had not been promised such a thing. In addition, the prosecutor from the Department for the Investigation of Police noted at the time that when Malka arrived at the refresher, he raised a claim regarding a promise regarding the parole board. However, an inquiry conducted at the time with the management of the Department for the Investigation of Police revealed that he had not been promised anything in this regard (21274-21275).
