I will address the various arguments:
(a) The alleged contradiction regarding the purpose of the money - The situation in which the trial was conducted, i.e., without Ben-Eliezer's testimony being heard, is such that it creates certain ambiguities with respect to various factual claims. Against the background of these words, there is no room to accept the prosecution's argument regarding differences in the purpose of the money, since these differences may be rooted in Ben-Eliezer's words to each of those involved in providing loans in his favor. It is not impossible that Ben-Eliezer, who was proven to have asked for different sums of money from a variety of people, presented his earlier request for a loan from Ezekiel as intended to enable him to run for the presidency of the state, and it is not impossible that the request for a late loan (the second transfer of funds) was explained by Ben-Eliezer in his application to the defendant, as rooted in his health condition and his desire to move into an apartment that matched his difficulties. This assumption is also consistent with the defendant's anger at Ben-Eliezer in relation to the presidential race and his desire that Ben-Eliezer leave the public service and focus on taking care of his health. In any event, it is not possible to learn from the alleged difference in the "purpose of the loan" the existence of a contradiction, and it is certainly not possible to conclude from this the failure of the defendant's version.
(b) The incompatibility between the amount of the loan described by Yechezkel and the amount actually transferred - As explained above, Yehezkel described at the beginning of his interrogation the amount of the loan as ranging from $40,000 to $60,000. Later on, Yechezkel referred to the sum of $50,000 as the sum that was apparently discussed, but an examination of his version from beginning to end, including his testimony in court, shows that it is impossible to know, over the years, the exact amount that was discussed, and certainly no conclusion can be drawn from this about the failure of his version.
