(a)           Assistance in obtaining a drilling license "Med Ashdod"

On February 8, 2010, the Petroleum Council, which operates under the Ministry of Infrastructures, decided to grant a group called ACC Oil drilling license at the Ashdod Med drilling site (hereinafter – ACC; The License).  At the head of the ACC Haim Leibowitz was standing at the time, and his partners in the group were the defendant and Ben-Zaken.  The defendant and Ben-Zaken requested that the rights of the ACC Licensed by the author ACC to an oil company.

It was argued that Ben-Eliezer, although he did not serve at the time as Minister of Infrastructures (but rather as Minister of Industry, Industry, and Industry), remained in a position of power and influence over the employees of the Ministry of Infrastructures and members of the Petroleum Council, and acted to improve the chances of Shemen meeting the conditions set for the transfer of rights in the license, in two ways:

(1)           Promoting a meeting between Shemen and the CEO of Noble Energy - It was claimed that one of the conditions for receiving the license was a proven professional ability to drill oil, and for this purpose, Shemen sought to contract with Noble Energy, an international company that specializes in the exploration, drilling, development and production of natural gas and crude oil around the world.  On December 1, 2010, Ben-Eliezer approached Eli Kamir, who served as Noble Energy's communications consultant, through Azoulay, in order to promote a meeting between Shemen and the CEO of Noble Energy, which took place on December 6, 2010.  At the end of the day, Shemen met the conditions of proven professional ability to drill oil in a different way, and after the defendant was able to forge a deal with another company.

(2)           Ben-Eliezer held talks with the head of the Petroleum Council in order to promote the affairs of the Shemen Company - It was claimed that on a date unknown to the accuser, and while Ben-Eliezer was serving as a minister, he was detained until the end of the proceedings, he spoke with Dr. Yaakov Mimran, who served as the Petroleum Commissioner in the Ministry of Infrastructures and headed the Petroleum Council (hereinafter – Mimran), and asked him to make decisions that benefit the oil company.
