(a) On February 14, 2011, defendant 5 asked defendant 4 to contact him with the comptroller of the Ministry of Infrastructures, David Biton, in order to obtain information from him about what was happening at the Petroleum Council in preparation for a meeting on Shemen's case and to exert pressure on him.
(b) On March 16, 2011, a council meeting was held, during which the council members discussed the request ACC to transfer its rights under the license to the Shemen Company (hereinafter – the Yeshiva).
(c) At the request of defendant 5, throughout the session, defendant 4 was in regular contact with David Biton, the accountant of the Ministry of Infrastructures, who was appointed to this position during Ben-Eliezer's tenure as Minister of Infrastructures, and received information from him about the position of the council members in real time.
(d) Defendant 4 provided Defendant 5 with the information that was leaked to her as stated above, as well as information she received as a result of her contacts with council members after the meeting, to whom she contacted as the manager of Ben-Eliezer's office.
(e) At the end of the hearing on March 16, 2011, the Council rejected the request ACC Transfer of the rights in the drilling license to oil on the grounds of the lack of proven financial capability of oil.
- Defendant 5 received from Defendant 4 information that was not published to the public about the position of the council members, and began to act through every possible channel – both by contacting his attorney in letters to the council members, by motivating defendant 4 to take action against the council members, and by exerting improper pressure on some of the council members, all in order to make a decision in favor of transferring the drilling license rights from a company ACC For oil, as follows:
(a) At the end of the Council meeting on March 16, 2011, Defendant 5 contacted Council Member Yossi Matza (hereinafter – Matza) and pressured him to meet with him on the same day and the next day, in exceptional places and times, in order to change his position and vote in favor of the transfer of the rights in the drilling license from ACC For oil.
