As for the first element (The person who takes the bribe is a public servant) – both the law [see for example Section 290(a)(2) to the Penal Law] and the case law have taken a broad approach with respect to this component. In our case, and therefore there is no need to elaborate, there was no dispute that Ben-Eliezer was a public servant during the relevant period.
As for the second element (The nature of the bestowal) – it is possible to refer to the language of Article 293 The Penal Law, which deals with "bribery methods":
"There is no difference in bribery.
(1) If there was money, the value of money, service or other benefit";
The broad wording of the definition "deliberately" does not delimit the methods of bribery within strict boundaries, and it has been determined in case law that it necessarily stems from the fact that the scene of giving and taking bribes is liable to simplify and take different and strange forms, and hence the difficulty of exhausting all of them in a closed list [Criminal Appeal 8027/04 Allegrissi v. State of Israel [Published in Nevo] (23.2.2006)].
Also in relation to the third element (in favor of an action related to the performance of his duties) – it was determined Section 293(2)-(7) To the Penal Law, the following alternatives are:
“)2) If he was in favor of doing or in favor of cessation, delaying, sensitizing, slowing down, favoring or discriminating against him;
(3) if he was in favour of a particular action or to be biased in general;
(4) if he was in favor of the client's own action or in favor of his influence on another person's action;
(5) if it is given by the giver or through another person; If it is given to the taker or to another person for the taker; whether le-khatḥila or be-di'avad; and if the beneficiary of the bribe was the taker or another person;
(6) if the client's role was that of authority or service; whether it was permanent or temporary, or general or for a specific matter; whether it was paid or unpaid, whether voluntarily or in fulfillment of an obligation;
