3.5.2. The winner undertakes that all contracts signed between him and the apartment buyers will be drafted in accordance with the principles detailed in Appendix 6 to the building contract ("Terms in a Uniform Contract between the Developer and the Apartment Buyer").
3.5.3. The winner will determine in the sale contract of the Mehir LaMishtaken apartment that the buyer will not be allowed to sell the apartment to a third party, starting from the date of its purchase until 5 years have passed from the date of receipt of Form 4 for the apartment, including an agreement for the transfer of rights after the end of the five years, which was concluded before the end of the aforementioned five years. However, the buyer will be entitled to rent the apartment for residential purposes only.
3.5.4. To ensure the above, the winner will require the purchaser to sign an affidavit and a letter of undertaking For the benefit of the firm or anyone on its behalf, which will be attached to the sale contract, in the wording that appears in Appendix C7 to the construction contract.
3.5.5. If the buyer breaches his obligation and sells the Mehir LaMishtaken apartment before the aforementioned date has passed, he will be obligated to pay a fee of NIS 450,000 to the office.
3.5.6. In order to ensure that the buyer of a Mehir LaMishtaken apartment complies with the terms of the letter of undertaking, a warning note will be registered by the winner in the Land Registry and/or in the books of the winner, who is responsible for carrying out the registration procedures and the procedures for transferring the rights until a note is registered in the Land Registry. Without derogating from the aforesaid, the winner shall, upon signing the construction contract, produce irrevocable notarized power of attorney, For the benefit of the Ministry or anyone on its behalf, To record this cautionary note and all that entails.
3.5.7. The granting of ownership rights to Mehir LaMishtaken apartments will be approved by the ILA and in accordance with the rules that will be determined in the matter.
