3.5.8. The winner will determine in the sale contract provisions regarding the specifications of the apartment and the building as detailed below:
3.5.8.1. The specifications of the apartment and the building shall not be less than the binding specifications attached to this contract.
3.5.8.2. The purchaser will not be allowed to make upgrades from the date of signing the sale contract until receiving the apartment key, and it will not be possible to receive a credit against the waiver of components in the specifications, except for a credit against and a production on all components of the specifications as detailed in clause 3.3.12 above.
3.5.9. The winner will determine in the sale contract the amount of the financial credit that will be given to the apartment buyer against the relinquishment of one of the items listed in clause 3.3.12."
- Appendix C6 to the building contract, including instructions regarding the formulation of key terms in a standard contract between a seller and an apartment buyer (hereinafter – Wording of Terms in a Uniform Contract between a Developer and an Apartment Buyer) - See page 233 of Mr. Friedman's affidavit. This appendix includes precise provisions regarding clauses that must be included in the sale contract between the appellant and the buyer of an apartment in the "Buyer's Price" project, as well as binding wording that the appellant was required to include and implement in the sale contract.
Just for the sake of example, I will bring what is stated in section 2.b. The wording of the terms in a uniform contract between a developer and an apartment buyer, which deals with "late delivery", where it was stipulated:
"Except as stated in this section, the seller may not postpone the original delivery date set in the contract for any reason.
The following will be presented Binding Wording which the seller must include in the contract in connection with the postponement of the delivery date and in connection with compensation for the postponement of the delivery date. The seller is not entitled to change this wording or to stipulate it. Notwithstanding the aforesaid, the seller is entitled to set a higher rate of compensation than that set out in section 6 of the binding version below.
