Witness, Plaintiff 4: I said to him, "Father, what did you do, why did you do that?" He said he was under pressure to influence him, he was about to fly out of the house, they threw him away. And I live in Bat Yam, each in his own corner, as if we were bought together and after a month she knew how to do it" (pp. 60, 9-13).
- She also confirmed in her testimony that she did not act in any legal way to cancel the agreement during the father's lifetime:
"Adv. D. Gilad: What did you do as a daughter who loved her father when you found out that your father claimed ----- cheated on him, you went to court, you went to the police, you contacted the authorities, what did you do?
Witness, Plaintiff 4: What can I do?
Adv. D. Gilad: You can't do anything?
Witness, Plaintiff 4: I can't do anything, he told me you can't sue for it..."
(p. 61, paras. 24-31).
- In contrast to the plaintiffs' version, which was refuted in their testimony, and it turned out that they knew in real time or close about the transfer of the house as a gift, and the sisters even confirmed that they were offered to participate in covering the deceased's debt to plaintiff 2 and in return they would be registered as having equal rights in the house but none of them acted to cover the deceased's debt, stands the defendants' version that stood as stable and consistent as a wall in shape. and was not concealed during the proceeding.
- The defendant was asked in the cross-examination whether she had shared the process with her sisters before signing the gift agreement, and she answered in the affirmative. The defendant explained that she had personally approached plaintiff 1 and her sisters out of a desire to cooperate and share responsibility, but when she realized that there was no response on their part, she took upon herself the obligation towards her father and daughter (pp. 192, paras. 21-24):
"The defendant: I was with plaintiff 1, she told me to talk to my husband, I spoke to her husband. I swear to you that my children visited me, he told me I don't care about it, I don't want it under any circumstances. He erased me completely, then she told me he didn't want to, so what should I do, he won't."
