- In accordance with the plaintiff's affidavit, she approached the defendant with a request to return to work, but he replied to her, on February 4, 2024: "I don't need to come, I will be in contact" (paragraphs 11-12 of the plaintiff's affidavit).
- The plaintiff's husband also testified that the plaintiff told him that the defendant was not interested in her returning to work after her unpaid leave (page 33, lines 31-32).
B.2. The Plaintiff's Return to Work
- On February 11, 2024, the plaintiff returned to work. As appears both from the defendant's affidavit and from the plaintiff's own statements in her interrogation (see page 6 of the transcript, line 7), the defendant did not support her return to work.
- To be precise: the plaintiff made it clear in her testimony that she returned to work on her own, without the defendant's approval (page 6, lines 32-37). The defendant was asked in his interrogation why he allowed the plaintiff to come to work on her own, and replied that the plaintiff's sister (who was also employed in the defendant's office) asked him to assist the plaintiff in light of her personal circumstances (page 42, lines 1-6).
- At the same time, the plaintiff testified that she asked the defendant for a letter of dismissal, but he refused (page 6, lines 9-12).
- Copied from Nevobetween me and me, according to the plaintiff, on February 13, 2024, she discovered that she was pregnant during a home test (paragraph 16 of the plaintiff's affidavit). It should be noted that this version is not mentioned in the statement of claim, and it was first mentioned in the plaintiff's affidavit.
- Moreover, the plaintiff claimed in her interrogation that she had a copy of the home test, but she did not present it to the defendant because he did not ask her to do so. According to her, she did not save the picture (page 26, lines 1-11).
- Thus, the plaintiff did not present, neither in real time nor retrospectively, a photocopy of the results of the home test, which she claimed, on February 13, 2024.
B.3. The first meeting from February 19, 2024
- On February 19, 2024, the defendant summoned the plaintiff to his office, for a conversation that he defined as a hearing call:
"... I'm now like it's the hearing, what's the date today it's the 19th, okay. Now what I wanted was something like this... I want to keep you busy, want and appreciate it very much here and there, but the matter doesn't work out somehow...
