In response to the plaintiff's lack of ILS 209, Miri replied as follows:

"125 ILS health insurance

And the coral will pass on the difference to you."

In other words, this correspondence supports his claim that ILS 37 per hour was agreed upon with him and that a certain amount was supplemented to him in cash.  However, even this correspondence does not fully support his version, since it indicates that he received ILS 37 per hour after deducting medical insurance contributions - something that was not mentioned in the statement of claim or in his affidavit.  In addition, it is not possible to know what happened after that correspondence and whether the plaintiff actually received the difference as aforesaid.  An examination of the pay slips indicates that the plaintiff was not deducted for medical insurance contributions during any of the months in which he worked for the defendant.  Moreover, the plaintiff's version is inconsistent with the other conclusions drawn from the analysis of the pay slips as described above at length.

  1. As to the transcript of the conversation between Mordechai and the plaintiff Gautom - as stated above, even in the case of Gautom we are not convinced that the aforesaid indicates that an hourly wage was agreed upon that was different from what was stated in the pay slips. Moreover, it is not necessarily possible to conclude from the agreement and the conduct with one employee regarding the agreement and the conduct with another employee, since this conversation concerned Gautom and his wages and not Job.
  2. Mordechai attached to the appendices on his behalf a transcript of a conversation attesting to an exchange between him and Ayoub close to the end of his employment with the defendant. Mordechai begged Job to give advance notice before he left, and warned him that he would have to deduct advance notice from his salary, if it was not given. In response, Ayoub claimed that he had been promised a salary increase and that the parties had argued about the salary that had been paid to him up to that time, as stated there (Appendix N4 to Mordechai's affidavit in Ayoub and Guttum's lawsuit):

"Mordechai: I'm just, listen, Job, you're a good person, but I'm just informing you, I don't want your salary to go down.
