As to the manner in which the salary was paid, Mehri claims that he first received the salary by bank transfer and later his salary was paid in cash, as stated in paragraph 13J of the statement of claim (in his affidavit he changed his version and claimed that he was paid both in cash and by bank transfer, and after a certain period most or all of the salary was paid in cash - section 6J of the affidavit).  According to him, there were months in which two pay slips were issued for his work - in his name and in the name of his wife (who did not work for defendant 2), for which the bank transfer was made (paragraph 13J of the statement of claim and paragraph 6B of the plaintiff's affidavit).

  1. On the other hand, according to the defendant, Mehri's hourly wage was a minimum wage (ILS 29.12 per hour) in accordance with the subscription in the employment contract and the pay slips (paragraphs 11 and 13 of the statement of defense). The plaintiff's salary was paid by bank transfer (paragraph 15 of the statement of defense), and the salary paid to the plaintiff's wife was paid for her work and not for the plaintiff's work (paragraph 16 of the statement of defense).
  2. As will be detailed below, the law of arguments from Hari regarding the amount of the salary is to be accepted.
  3. As for the notice to the employee, in the statement of claim and in the affidavit, Mehri claimed that he had not signed an employment contract and had not received such a document (paragraph 69 of the statement of claim and paragraph 6K of the plaintiff's affidavit). However, when asked about this in the cross-examination, he confirmed that he had signed a notice to the employee (which was submitted through a "submitting witness" - Mordechai) but claimed that he had recorded "I do not understand" in the Amharic language, as stated in his testimony (Appendix N2 to Mordechai's affidavit and as stated in the plaintiff's testimony on p.  20, paras.  5-21 of Peru, emphasis added):

"Adv. Rafael:                         ...  I'm showing you your employment agreement, it's an agreement that Mordechai gave you in the Tigri language when you started working, confirm to me that it's your signature below.
