Adv. Rafael: So it's 1,000 shekels for Shabbat, 1,000 shekels for Shabbat?
The witness, Mr. Sagaber: It's Friday night, Saturday.
Adv. Rafael: Okay, 1,000 shekels?
The witness, Mr. Sagaber: We work Friday night, Saturday many hours, 16 hours, 17 hours.
Adv. Rafael: Okay, 16 hours, 17 hours, 1,000 shekels?
The witness, Mr. Sagaber: Yes, 700, 800 like that. On the holiday we work a lot of hours sometimes and he gives us it in cash, he says 'it's incash', cash" (emphasis added).
- It is not clear from his version how much he received per shift (ILS 1,000 or ILS 700 or ILS 800) and how long it lasted.
If we assume that the sum that the plaintiff stated in his testimony (ranging from ILS 700 to ILS 1000) refers to 32 hours of work on Friday and Saturday (the number of hours he claims to have worked on these two days together - as stated in paragraph 6C of his affidavit), then it follows that he was paid an hour in the sum of ILS 21.875 (= 32 hours/ILS 700) or ILS 31.25 (= 32 hours/ILS 1000). Insofar as the plaintiff's intention is that he received the said sum for 16 hours of work on the Sabbath, then this means that he was paid per hour between ILS 43.75 and ILS 43.75.(= 16 hours/700 NIS) and 62.5 ILS (= 16 hours/1000 NIS).
These figures are inconsistent with the plaintiff's version, according to which Mordechai paid him on Shabbat as he paid him for regular working hours - i.e., ILS 32 or ILS 35 or ILS 37 per hour.
- As will be detailed later in detail, the plaintiff's version regarding the format of the working hours is also inconsistent.
In his affidavit, the plaintiff claimed that he worked 7 days a week - Sunday to Thursday for about 8 hours (from 7:00 to 15:00), and on Fridays and Saturdays he worked about 16 hours every day (from 7:00 to 15:00 or 16:00 and then from 16:15 or 17:00 to 23:00 or 24:00). In other words, antitrust - 72 hours a week, 300 hours a month (according to the version in the affidavit, the plaintiff worked 40 regular hours a week (8 hours * 5 days) and 32 hours on Fridays and Saturdays (= 16*2). Monthly supermarkets - 300 hours (=(4.3 weeks * 40 regular hours) + (4 Saturdays * 32 hours Saturday)).
