On December 22, 2024, MAG Required to submit to the Council pricing, cost and profit estimate for the tender.
After completing the documents, the Council was given a professional opinion, which recommended accepting Mag's proposal.
- On January 2, 2025, Zalul approached the ISBB and claimed that Mag's proposal does not meet the threshold conditions in clause 11.4 of the tender terms, which defines the required experience. Zalul's request was accompanied by letters from various local councils, stating that it had not carried out any cleaning work on their premises.
In light of these letters, the council contacted representatives of the relevant local authorities, who stated that "It is very possible that they did provide cleaning services to the authorities in which they work".
- On February 4, 2025, MAG participated in another hearing in the Council, in which it was agreed that it would have to produce additional documents, related, inter alia, to cleaning work that MAG claims to have carried out.
On February 9, 2025, MAG sent the documents, which were forwarded to the Council's legal advisor for review.
- On February 18, 2025, the tenders committee convened again, and approved MAG as the winner, after an economic examination of its proposal was conducted and it was decided that it was reasonable and could be approved. The tenders committee determined that the documents proved that MAG had carried out cleaning work for the same authorities it had registered in the bid.
At the conclusion of the discussion, it was decided that "In accordance with the opinion of the appellant family and the professional opinions, the tenders committee decides (unanimously) to recommend to the head of the council to declare [Mag] as the winning bid in the tender, and to define [Zalul] as the winner as a second qualified bidder for the tender."
- On March 10, 2025, the Council sent a notice to Zalul that it was "second qualified" in the tender.
In accordance with Zalul's demand, the Council provided it with the tender documents (on March 12, 2025).
