In fact, the court-appointed expert's analysis adds substance to this matter, and his argument is not hidden.

71. This body of evidence is sufficient to show that the circumstances that constitute the presumption of use exist. The defendants had access to the plaintiffs' third trade secret, and their opening was substantially similar to their opening.

The court's expert position that the development of such a chip required research and development was not contradicted and that the defendants did not point to independent research and development in respect of it

72.     The starting point in this section is that the expert confirmed that he had received from the plaintiffs the vast majority of the documents and data that he requested from them, which substantiate the research and the research they had invested (620, Q.  8-1).  He further testified that without research and development, it is not possible to reach a product that includes the plaintiffs' secrets, and such research and development was not established by the defendants (616, Q.  29-19):

There was not, there was no R&D to breathe, no air to breathe, a fairy of melody.  There was no R&D for the chip house for its architecture.  There was no real design, there was no R&D for the antenna itself, he took it, it saw [and] sanctified and not from a park, I will soon see that it is not from a park, even though Adv. Liraz tried to say that it is somehow inside a park, in every field and field that is within the field of mind of both the invention I call 036 and the product he published on 13/05/2020 there is no R&D, If the judge accepts that it is possible to reach an inhaler who works without R&D, he will.  As a court witness who is in charge of R&D, I'm 60 years old, about 20 years, about 40 years old, I don't believe in it, I don't see that it's completely possible, and also the results of Professor Seroussi show that, because Professor Seroussi failed both in the first experiment with Park and in the second experiment with X, he failed, how, how, how will he succeed without R&D?
