Adv. Giller:                  For private accounts.  Please tell me, does the interpreter have control over your accounts or did you transfer the money wherever you wanted to transfer?

The witness, Mr. Feldman:     Of course not, it has nothing to do with the interpretation of my accounts.

Adv. Giller:                  In other words, the transfer of money from your account, yours and your wife's account is done by you at your sole discretion."

  1. Without derogating from the aforesaid, in any case I do not believe that there is any substance to the plaintiff's claims against Adv. Winder. Thus and first of all - I will note that the plaintiff's claims that she did not understand anything, that she was not involved in the details of the transactions, that she did not understand from the outset the meaning of the transaction that she is linking - were in any case rejected by me.  In these circumstances, I find it necessary to cast doubt from the outset as to the plaintiff's claims, according to which no explanations were given to her.

Moreover, I will note that in light of the plaintiff's claims that Adv. Winder did not explain anything to her and that the entire meeting with him took place for a few minutes.  In his testimony, Attorney Winder noted that he explained to the plaintiff the nature of the transaction as well as the risks involved in it.  Thus, on page 30, lines 9-14, Attorney Winder testified that:

"Unfortunately I have to deny this claim, it's not true, she was in my office, she had the opportunity to read, I explained it to her well and not only did I explain it to her well, but even on that occasion I expressed my opinion, that in my opinion they are making a mistake and they may lose their house as a result of this loan.  I explained very well the meaning of signing this document, what was written in it, she confirmed that she knew what was written in it, unfortunately it is the truth."

Adv. Winder further testified, regarding the risks that were explained to the plaintiff, on page 34, lines 5-15 as follows:
