The same is true of the IPS's functioning. This is a hierarchical system, which is at the core of the rule of law in Israel, and the discipline and ways of behavior found in it must be impeccable (High Court of Justice 6208/04 Abu Amra v. Commissioner of the Israel Prison Service [Posted inNevo] (2.9.2004); High Court of Justice 6128/06 Abuksis v. State of Israel Prison Service, [Posted inNevo] Paragraph 10 (January 3, 2007)). It is even more important to have the immaculate behavior of IPS prison guards, in view of the built-in position of power in which they find themselves vis-à-vis the population of prisoners and detainees and the fear of exploitation of it. Individually, Offenses of sexual harassment and indecent act by a prison guard in a detainee, taking into account the relationship of authority, the built-in class gap between them, and the control and power that the guards have over the prisoners over whom they are responsible, are offenses that must be treated very seriously. Finally, the data presented refers toDismissal, as opposed to a decision not to extend service.
SummaryI would suggest to my colleagues that the appeal be dismissed and that the appellant bear the respondent's expenses in the sum of ILS 10,000.
