More, The witness added that:

"A: The exercise ended after the second part at the barbershop in which the suspect says what happened it stayed in the heart.  It was a mistake in identification, At some point I asked him if it was like that, You only see my hand.  Whether it was like this or that.  And then he told me it was like this.  Ok?

22' Judge Hellman: The witness demonstrates, if we understood correctly, one sign intended to show the sign of shooting or the use of a gun and the other marking with a knife., And his answer was with a knife."

(pp' 222 For the record, Lines 16 -23).

This is the place to dwell a little on the testimony of the defendant before us, From which arises, Because the informant pointed to him with the hand of the way the murder was committed, and he told him that it was with a knife (pp' 485 For the record, Lines 21 -22).  Further, In response to the question of how he knew this, he answered, "Because it was a month and a half later, I saw articles in the newspapers and all of Afula also knew about it" (See - pp' 485 For the record, Row 24 .  Yes, In this context, see - A/102, I'll dwell on that later., The variety of responses from them can be learned about the original content of the original article and the fact that, Because we were interested in a stabbing incident/Stabbings are the domain of many).

  1. Aberge'Yale was interrogated at length as part of the cross-examination and was asked, Among other things, Refer to the reason behind choosing the name "Aberge'Yul". According to him,, There was no particular reason for this (pp' 323 For the record, Row 8).  At the same time, He did know that this surname was indeed associated with a crime family.  More, Refer to Aberg'Yale to the meeting place where the dubbing took place in Notion: "It is very possible that during the conversation we moved off the road because the road is busy, but the conversation did not take place anywhere that is isolated, a dark alley, It was conducted in broad daylight on a main street, His uncle honked his horn, he went to his uncle for the car, Look at us people, Under no circumstances did I lead him to a hidden, dark place or that he would feel threatened in the situation".  (pp' 234, Lines 10 -14).
  2. Avberg also referred'Yale for the use of the word "Mistake" Countless times. According to him,, He did not know details about the murder incident, Hence; "...  The tactic I used was open words to let the suspect tell what he did, And not to come closed and say something prepared in advance, you murdered, you did it., ...  In order for a person to tell what he did, you have to use open words in open sentences, not closed sentences, that's the only reason I used the word wrong, There's nothing behind it here" (pp' 239, Lines 10 -15).
  3. Also the second informant, Bohbot, In his testimony before us, he referred to the course of dubbing when in his opinion - "The suspect was surprised at first, but he was surprised, not frightened, Communicate with us, Have a conversation with us, Understand what you want from him, Showed no signs of fear throughout the conversation" (pp' 259 For the record, Lines 23 -25).

Among other things, The informant was asked Bohbot Refer to the training/A warning received by the informant, In the context of fathers-The Invalid, Before he proceeds to carry out the task assigned to him.  (See - pp' 266 - 267 For the record).

  1. Is the accuser indeed correct in her approach and argument?, Because from the course of things, From the testimonies and the existing evidence, and even from the defendant's mindset, Can be determined, Because there was no use of the invalid ancestors here.? Did the defendant not act out of fear of the situation he found himself in, and/Or from the conduct of the informants? Is it true - You can learn about cooperation on the part of the defendant (With the informants) Freely and voluntarily? Hearing the dubbing tape and in an attempt to simulate the situation in which two men approach the defendant/Minor {Small in size (At least in relation to the informants) As we were impressed during the court hearing} In the middle of a main road, And they talk to him when they mention the word "Mistake" countless times and ask for his help in finding a solution to the problem they found themselves in., Using the name " Aberge'Yul" And in words such as; "Chava" and while talking about a debt that amounts to the sum of - 300,000 NIS or higher; Given all of the above - It is impossible to ignore the power and predatory attitude that the informants demonstrated and projected towards the defendant. Here is the place to note, Because at the beginning of dubbing (See - pp' 1 Row 16), The informant turned to the defendant and told him: "Be calm, be".  Yes during dubbing is evident, that the defendant tried to extract information from the informants regarding the method and/Or the way you can choose to help them (For example, See - pp' 2 Row 13 (Name, The defendant said: "What's the matter, explain to me the matter that...." And later on., Row 20, This is what the defendant says: "How do you want me to help you what?").  Berry also, that the defendant was pressured upon hearing the amount of the debt amounting to the sum of - 300,000 ₪.
  2. Later in the same meeting, When the defendant went with his uncle to get his hair cut and again met with the informants, it is evident, Because the informant will be'Yale did not let go of the defendant (who denied at the beginning of the conversation that he had committed the act attributed to him) And he began to ask him questions continuously, until he reaped the fruits of his labor., And so it was:

"Tax Spokesperson' 1, The Machine "From" 1: Now tell me why...
