- As stated, there is no dispute that the Applicant meets the conditions of registration for the National League and that she has made preparations that include many expenses for the purpose of her absorption into the National League, and that she will suffer real damage if she is not accepted for registration in this League.
The Association's counsel also fairly admitted in the hearing before me today that he recognizes the Applicant's damage, although in his opinion "this harm has been withdrawn due to conditions of interest both of the league as a whole, of the entire industry and of all the teams, including Modiin."
- On the other hand, no damage will be caused to the other teams in the National League or even in the National League as a result of the granting of the temporary relief, as detailed below.
- In accordance with the rules of the Women's League, it is possible to allow them to be admitted to the National League, and there is no dispute that at this time only 10 teams are registered for the upcoming season. Hence, the continued existence of the National League is not in danger to the extent that the Applicant is accepted into the National League, since there will be 9 teams left in it, in a manner that will enable the receipt of budgeting, so that the balance of convenience is clearly tilted in favor of the Applicant and no damage will be caused to the Association and the other teams.
The other teams that were not included in the application also did not petition on their behalf against the Association's decisions not to order their inclusion in the National League, and therefore it is not possible to see what damage was caused to them as a result of the acceptance of this petition.
