From the aforesaid, it can be concluded that the dispute must be in matters related to the activities within the framework of the association in order for it to be under the exclusive jurisdiction of the arbitration institution of the Football Association.
In our case, the dispute between the parties stemmed from a radio broadcast in which, according to the claim, publications regarding the respondent constituted defamation, according to which the latter was involved in the bias of a soccer match. The harmful action in the case referred to us is a publication that constitutes defamation, this action is not considered an action within the framework of the association in a direct and clear manner. At the same time, in light of the legislature's intention and the trend of the case law to expand, as stated, the circle of disputes that are under the jurisdiction of the arbitration institution, the dispute that is the subject of the hearing can be viewed as a dispute related to actions within the framework of the association in light of the fact that the content of the publication underlying the dispute was in relation to the action that was claimed to have been done by the respondent within the framework of the association and that he was in a position of trustee in a stay of proceedings.
In the framework of the decision of the dispute that is the subject of our discussion, a discussion of a main question will be required, namely, whether the publication describes a real factual situation that actually occurred. For this purpose, it is necessary to examine whether the respondent was indeed involved in the bias of the game, this question is a question that relates to sports matters, the decision of which will require skill and proficiency in this field.
On the basis of the above, I am of the opinion that the dispute that is the subject of the claim is considered a dispute within the framework of the Association, which relates to sports matters.
But this is not the end of our examination and we must move on to the next stage and discuss the second question, which is whether the parties to the dispute fall within the scope of the Sports Law for the purpose of transferring the hearing to the arbitration institution.
