Judge Landau, despite his conclusion that Bnei Sakhnin is responsible for her refusal to play the game, does not order her conviction for this offense, nor does she acquit her.
- The Dayan, Mr. Noam Lubin (hereinafter: "HaDayan Lubin") follows a different path. According to Judge Lubin, only the Bnei Sakhnin team is responsible for not holding the game, due to its refusal to comply with the referee's instructions to go up to the pitch. Hence, Judge Lubin believes that the result of the game should be 3:0 in favor of Hapoel Be'er Sheva.
- In the opinion of Dayan Lubin, if the match referee had decided not to hold the game after the outburst of the teams' fans, the responsibility for not holding the game could have been attributed to the fans of both teams. However, when after the winds calmed down, the match referee thought that the game could be held, then the only person responsible for not holding the game is Bnei Sakhnin in its refusal to go up and play.
In the opinion of Judge Lubin, the rules and rulings of the Disciplinary Court determine that what is stated in the referee's report is final and absolute, and therefore when the referee instructed the Bnei Sakhnin players to go up to the pitch and they refused, there is no longer any responsibility for Hapoel Be'er Sheva, but only for Bnei Sakhnin.
- Judge Lubin also refers to the penalty of deducting a point from the balance sheet of the Hapoel Be'er Sheva team, and faithful to his position, he believes that this penalty cannot be imposed. In his opinion, it was not the fans' rioting that caused the game not to take place, but only the refusal of Bnei Sakhnin. Hence, this is not a case of a fan riot in aggravated circumstances (when the aggravating circumstance that was claimed is that the game did not take place due to the riot), and in the absence of aggravating circumstances, there is no authority to reduce a point.
- In light of the above, and in accordance with the majority opinion, it was determined in the summary of the judgment that the teams would be fined financially as well as a deduction of one point for each of the teams due to a conviction for the offense of fan rioting under aggravated circumstances.
Regarding the result of the game, in light of the shared responsibility for not holding the game, it was set at 0:0 without points.
