A viewing report was submitted by Policeman Yogev Cohen on July 25, 2022 (P/37).
On the basis of the aforesaid, the seizure of the footage from the camera at 87 Weizmann Street in Bat Yam was done without a warrant and without informed consent, and therefore there were flaws in the police's work in the seizure of the footage.
- Videos taken from cameras At 7 Halamit Street in Bat Yam (P/53) were submitted through Policeman Daniel. A report of a visit to the scene was submitted to the ZIT investigator prepared by Policeman Daniel on July 25, 2022 (P/52), detailing security cameras seized at 7 Halamit Street in Bat Yam, with the consent of Mr. Yitzhak Shinborn. A request was filed to back up and download video files from cameras at 7 Halamit Street in Bat Yam made by Policeman Daniel on July 24, 2022 (P/55), in which he was asked to download materials between 13:20 and 13:35. Officer Daniel noted that he produced the digital evidence and burned the files on a CD without modification or editing. Attached to the application was a "Owner's Consent Form" (in the usual version) signed by Mr. Yitzhak Sheinbrunn in the presence of Policeman Nati Hoshir. Officer Daniel stated in his testimony that he arrived at the address of 7 Halamit Street and spoke with the person he thought was the manager of the place, who gave his consent to copy the videos from the cameras (pp. 280-281 of Pruth).
Mr. Sheinborn testified in court and stated that he volunteers at a soup kitchen as part of an association run by "Rabbi Leon", at 7 Halamit Street, and that he did indeed sign an owner's consent form for downloading digital media files dated July 24, 2022 (P/55), and authorized the police to check the cameras. In his cross-examination, the witness stated that there was activity at the site (p. 210 of Prot., paras. 20-26). Mr. Sheinborn stated that he serves as the rabbi's deputy and fills his place in his absence (pp. 210-211 of the protégé). Mr. Sheinborn said that on the day the police arrived, he was in charge of the place, in the absence of the boss, and that he personally could not "mess" with the cameras, and as far as he was concerned, "as soon as a policeman arrives, no matter what, for whatever reason, there is a certain reason, they let him in, they don't block him because we won't start making a mess of anything now... We are law-abiding and we are allowed to bring in any policeman who, if he has an unusual problem, can enter the media" (p. 213 of the protégé).
