It was noted that according to the prosecution's opinion, one gunshot wound was found on the defendant, and two gunshot wounds were found on his hair. According to Rosengarten, such a quantity of gunshot remains has limited evidentiary value, cannot be attributed any weight to them, and such a result can be ignored. He also noted that according to the report, one bullet remnant was found on the defendant's pants, and two bullet remnants were found on his shirt. According to Rosengarten, even such a quantity of gunshot remains has limited evidentiary value, which means that no weight can be attributed and such a finding can be ignored.
Rosengarten added that according to the report in the opinion, ten gunshot remnants were found on a helmet, twelve gunshot remnants were found on and inside the delivery bag, and no gunshot remains were found on the bicycle on which the delivery bag was found. The bicycle, the helmet and the delivery bag were brought to the police station by a Special Patrol Unit officer, about whom Rosengarten assumed that he was "probably armed, and as such, was contaminated with remnants of gunfire." From here, Rosengarten sought to conclude that "a Special Patrol Unit officer could be a source of contamination displayed in the remains of gunfire."
It was noted that the bicycle was sampled for the remains of gunfire at 6:20 P.M., the helmet at 6:30 P.M., and the defendant at 5:10 P.M. Rosengarten noted that he did not receive a form showing the time of the shipment bag sample, so he assumed that this sample was taken specifically before the defendant's sample, as opposed to the bicycle and helmet. Rosengarten raised the possibility that the policeman who collected the backpack, bullet and bullet at the scene was contaminated with gunshot remnants, thus contaminating the rest of the exhibits on which the gunshot remains were found.
Rosengarten noted in his opinion that there was a significant discrepancy between the number of gunshot remnants found on the defendant and his clothes and the number of gunshot remnants found on the helmet and in the delivery bag, and that he would have expected that the number of gunshot remnants on the shirt of a person who shot would be similar to the number of gunshot remnants on the helmet he was wearing at the time of the shooting.
