The Man:                     I don't, I don't enjoy loyalty.

The woman's counsel:        You don't enjoy it faithfully, OK.  We'll check shortly.

The Man:                     Yes.

The woman's counsel:        Tennessee Was it established in marriage?

The man:                      Tennessee?

The wife's counsel:      Yes.

The man:                      Yes.

The wife's counsel:      It was established.  VIRGINIA Founded in Marriage?

The Man:         I remember yes" (See the minutes of the hearing of November 18, 2020, pp.  630-632, emphases in the original).

  1. In addition to the man's aforementioned confirmation in cross-examination, the woman verified the man's ownership of three of the trusts by another means-a lawsuit filed on the man's behalf in 2011 against the Oregon Foundation, which managed trusts for the man's family members, for over $10 million in damages caused by what he claimed was the mismanagement of the trust fund. In the aforementioned statement of claim, the man admitted that he was the beneficiary/founder/defender of the Alaska Foundation, Arizona A and Utah   Thus, the man argued in the aforementioned statement of claim (see paragraph 1 of Appendix 16 to the woman's summaries):

"The Plaintiff is the Settlor and or the Protector and/or a beneficiary of each of the following Trusts: Arizona, Alaska, Utah."

  1. In the aforementioned statement of claim, the man also detailed a list of six companies that he claimed were connected to these three trusts, including the Alabama Company (under the Alaska Foundation Trust).
  2. It is very reasonable to assume that the aforementioned trusts - in which the man confirmed his ownership - constitute only a partial list, since the woman's counsel could only question the man about the trusts that the woman had located in her efforts, in view of the man's refusal to name the trusts he owned. Thus, he was asked and answered:

"The Woman's Counsel:    Good morning.  I notice that you answer us according to the documents you think we have, or according to the information.  You check what we have, and you answer accordingly.  So now I want to ask you an open question.  Are there any trusts in which you today or during the marriage were in any position that we did not mention in their names earlier?
