Sec.  13(7) The aforementioned law expands the protection:

"A correct and fair account of what was said or happened as stated in paragraphs (5) or (6) in a public meeting, provided that the publication was not prohibited under section 21;"

  1. Thus, the legislature has chosen to grant full immunity to anyone who publishes a correct and fair report of legal proceedings and judicial decisions, even where they violate a person's privacy (or good name), provided that the initial publication is made by the judge, or within the framework of the judicial proceeding, and the proceeding is not conducted behind closed doors or under a gag order. These publications are permitted regardless of the good faith or other motives of the advertiser.
  2. The violation of privacy in the publication of data from legal proceedings was examined only recently by the Small Claims Appeals Authority (Central Districts) 48436-10-25 Yosef Ungerfeld v. Uri Kanner (November 23, 2025):

"At the opening of the previous lawsuit, the respondent filed a statement of claim and chose to detail his personal details.  In any case, in doing so, he exposed them to the other party and potentially to anyone who could have reviewed the case (by virtue of the Courts and Labor Courts (Review of Files) Regulations, 5763-2003).  The Respondent did not request a gag order by virtue of Section 21 of the Prohibition of Defamation Law or by virtue of Section F of the Courts Law, 5744-1984.  In other words, the statement of claim was filed in a public hearing.

The basis of the protection of section 13(7) is "accountability", i.e., it is required that the publication under examination constitute a report of a previous protected publication, in the sense that the reasonable reader will understand the source of the publication...  The publication of a photocopy of the title of the statement of claim, accurately describing what is stated therein, does not contain any addition, no omission in everything related to the plaintiff's details, and no removal from context.
