Kehat testified that the defendant's statements regarding his expertise and experience influenced his decision to invest in him (F. 26.2.2023, p. 195, paras. 30-33).
Kovacs testified that he reviewed the landing page as well as the videos sent to him, and that what was stated in the videos, and in particular the representation regarding the low risk, influenced his decision to invest (Feb. 26, 2023, p. 211, paras. 1-3; pp. 18-25; p. 218, paras. 1-11; p. 213, paras. 27-35; p. 214, s. 17); The witness also noted that he would not have invested if he had known that the activity was illegal (P. 26.2.2023, p. 215, s. 2). Regarding the promise of returns, Kovacs testified that the promise sounded "too good" and that he was aware of the risk that the account would be deleted in the event of a very sharp decline. However, he noted that this scenario "sounds like something that shouldn't happen" in the amount he invested, and that the risk of losing everything was low (February 26, 2023, p. 213, paras. 33-35; p. 214, paras. 5-14; p. 224, paras. 3-6; see also the re-examination, p. 230, paras. 30-35, p. 231, paras. 1-18).
Harel testified that he reviewed the landing page and that what was stated on the landing page influenced his decision to invest (F. 26.2.2023, p. 243, para. 6); and that what affected him more was the promise of a return more than the representation regarding the experience that the defendant presented (F. 26.2.2023, p. 239, paras. 10-11).
Buchnik noted that he became acquainted with the defendant through an online advertisement, reached the landing page and reviewed it, and that the representations that were presented had a significant impact on his decision to invest (P. 26.2.2023, p. 283, s. 18; p. 286, s. 21). In addition, it appears that the witness was impressed by the experience and expertise presented by the defendant.
Asa testified that he came to the defendant after hearing about him from a relative, and subsequently searched him through online channels and reviewed the videos and the landing page (March 8, 2023, p. 297, paras. 29-32; p. 301, paras. 10-17; p. 312, para. 26). Asa's testimony indicates that the representation regarding the promised return influenced him to invest, and that another central consideration that caused him to invest was that it was a legal activity (March 8, 2023, p. 302, paras. 3-11; p. 305, paras. 10-14).
