Buchnik.  According to the witness's testimony, the person who executed the robot's settings and the person who carried out the actions was the defendant using the robot, and the degree of his involvement in the account was minimal (February 26, 2023, p.  287, paras.  11-36; p.  291, paras.  1-17).  At a certain point, the witness showed involvement in the account, but it seems that the defendant's reactions to this involvement indicate the existence of a clear judgment on the part of the defendant.  The witness noted that following his requests, the defendant accused him that he would let him operate the robot or that he would trade himself (P.  26.2.2023, p.  284, paras.  33-34; and see also P/96, pp.  86-94).  Bat.  96, pp.  73-74, where the following correspondence can be found: After the defendant informs Buchnik that he is "operating a fence", Buchnik replies, "Why only now???", the defendant replies "because only now is necessary".  Buchnik later writes: "In my opinion, it's time to close the hedge positions," to which the defendant replies, "Do you want full control over your account? If so, he gives you a training course on the robot and gives you an operating license.  and from that moment on, it is under your management and your responsibility" (see also P/96, pp.  287-288).  For the sake of completeness, it should be noted that at a certain point, after Buchnik saw that the account was "out of control", the defendant closed all the commands and then changed the password and stopped answering him (P.  February 26, 2023, p.  291, paras.  32-35).  Later, Buchnik withdrew the money and closed the account (P.  26.2.2023, p.  292, paras.  1-4; see also P/96, pp.  33-34).

Khoury andAsa.  In response to the indictment, the defendant claimed that the two acted independently of the account (section 55), but this is not the case.  The two are relatives and there are similarities in their conduct vis-à-vis the defendant, and therefore we will treat them together.  It should be recalled that these customers, who were "heavier", opened a number of accounts in which a number of robots were installed (P/55, pp.  101-133; pp.  136-139; p.  178, s.  29 ff.).  In addition, each of them deposited large sums of money.  Khoury invested US$60,000 (Feb.  13, 2023, p.  140, S.  21; p.  166, S.  8), while Asa invested US$21,000.
