The plaintiff's claim that she did not receive publicity on the internal tenders should be rejected. Five internal tenders were published on the union's bulletin board and were exposed to all the employees, including the plaintiff. The plaintiff even confirmed in her cross-examination that she was present at the staff meeting on January 16, 2016, at which the expected process was brought to the attention of the employees.
The plaintiff chose, on her own initiative, not to apply for any of the internal tenders that were published. Moreover, the plaintiff knew of a tender that was subsequently published for the position of department manager after Mr. Lahav left his position, but chose not to apply for this position. The plaintiff submitted a candidacy only for the position of CEO of the Association, after Dr. Rosen's retirement.
There is no substance to the plaintiff's claim that the prerequisites for carrying out a hazardous materials alert were discriminatory and were "sewn" in advance. Hazardous materials standby requires specific education (chemistry, chemical engineering, natural/environmental sciences), appropriate experience and training, familiarity with factories and risks, and this is a heavy responsibility of "pikuach nefesh".
The fact that a single candidate submits an internal tender does not indicate "tailoring." [157] Usually, in internal tenders, the employees who have already fulfilled the actual positions are the ones who apply and win, and this does not indicate impropriety.
