Second, the complainants' version of repeated contact is also supported by evidence submitted in real time: Schiffer - as mentioned above, gave great confidence in his testimony in court - testified that they complained to him that the plaintiff was "touching them unnecessarily." In the clarification conversation with the plaintiff, Dekel presented him with complaints from male and female soldiers that he "often touches them," and Shouri added that "in every inquiry [...] It is accompanied by contact, and it makes some of the soldiers feel uncomfortable" (pp. 55-56 of the prosecution's exhibits). The transcript also indicates that they demonstrated to him in the clarification conversation the type of contact that arose in the soldiers' complaints, and that a discussion was held between them that dealt with the type of touching, with Dekel clarifying to the plaintiff: "Then there should be no such and not such" (p. 60 of the prosecution's exhibits). Even from the summary document of the command conversation that the plaintiff had with the chief education officer, it appears that he was presented with allegations about acts attributed to him, and not only about verbal statements. In the same conversation, the plaintiff denied what was attributed to him and "noted that the things that were written that he allegedly did constitute the exact opposite of the way he behaves and acts [...] And they are not technically possible." In the same conversation, he also denied the "situations described." If so, it appears from the summary document of the command conversation that the plaintiff was presented with complaints about acts attributed to him, and not only about verbal statements.
- The plaintiff's claim that the results of the investigation showed that nothing had happened is also incorrect, as appears from the summary document of the command conversation. The reason that no investigation was opened and no disciplinary proceedings were initiated against him stems, as the document indicates, from the female soldiers' choice not to file a complaint with the police (paragraph 5 of the document). The Chief Education Officer clarifies that he does not decide who is right and does not take a position or side, while it is written as follows:
It is appropriate to make it clear to Avner that he expects every civilian to work in the IDF [...] To treat the people around him with respect, while showing a high level of sensitivity in everything related to sexual relationships, since sexual harassment is a red line in the organization.
