The next day, the plaintiff was asked to drive the defendant's daughter again. After she and her escort got into the taxi, the plaintiff went out to talk to the defendant. They stood far away from the defendant's daughter. The plaintiff politely asked the defendant to place the defendant's daughter's bag in the trunk of the taxi, in order to prevent the defendant's daughter from scattering the sweets in the bag inside the taxi. Despite the plaintiff's sensitive and polite request, not only did the defendant choose not to comply with the request, but she began to shout at the plaintiff and curse vigorously. She called him - among other things - "son of a bitch," and even shouted at him: "Take the girl and get out of here, you insolent!" The plaintiff, who was shocked by the defendant's conduct, entered the taxi in disgrace and drove with the defendant's daughter to her educational institution.
- To the plaintiff's astonishment, on the same day his acquaintances drew his attention to a post published by the defendant, in which she presented a false and incorrect version of the events that took place that morning. The defamatory and offensive post includes a series of various residents, who live in Givat Shmuel, who expressed their anger at the plaintiff and cursed him as well.
If that wasn't enough, the defendant went further and called the manager of the taxi station where the plaintiff and his son work and demanded that the plaintiff be fired. This was also demanded by various residents, who were exposed to the defamatory publications.
- Summary of the defendant's defense arguments:
The defendant's daughter suffers from severe autism and has very low functioning. She is recognized by the National Insurance Institute as having a disability of 180%. This condition of the daughter is characterized, among other things, by the lack of communication with the environment and enormous difficulty in sensory regulation. The daughter suffers from severe tantrums and unbridled outbursts. Due to her condition, the daughter is legally entitled to transportation to the educational institution and to a close assistant.
