In the framework of the provisions regarding people with disabilities for educational institutions, which are detailed in the Ministry of Education's Director General's Circular, it was determined, inter alia, that the driver of the shuttle vehicle is not allowed under any circumstances to leave the bus as long as there are students in it, even if the driver has previously turned off the vehicle's engine.

  1. The plaintiff is not the permanent driver in charge of transporting the defendant's daughter. On the morning of the incident that is the subject of the lawsuit, the defendant helped her daughter get into the taxi.  The defendant makes sure - according to the recommendation of the therapeutic entity - that the daughter holds a snack during the trip.  This is not chocolate.  This is intended to lower the level of anxiety, and thus prevent the daughter from going on a rampage, which has already happened in the past.
  2. As soon as the daughter entered the taxi, and while the defendant was arranging her and giving her a snack to hold, the plaintiff began shouting in the presence of the daughter that the plaintiff should take the snack that the daughter was already holding. The defendant's attempts to explain to the plaintiff that this was intended so that the trip would pass safely, and that if she took the snack out of the daughter's hands, it might cause a terrible escalation in her reactions, they encountered an opaque wall.  The plaintiff insisted that the defendant pull the snack out of the daughter's hands.

Since the plaintiff's tone became harsh, and the defendant refused to obey him, the plaintiff opened the driver's door - while the taxi was moving, and the daughter with the assistant alone in the car - got out of the taxi and screamed at the defendant, "If she eats in the taxi, I will stop a taxi and drop her off in the middle of the road." The plaintiff added, "In any case, the dirty money she does to me is not worth it," and added, "It's not worth what they're paying me for the dirt that your autistic girl will do to me in a 200,000-shekel taxi."
