The plaintiff's arguments (the counter-defendant)
The plaintiff claims that the defendant fired him unlawfully, without giving him sufficient notice of the terms of his employment, and without paying him his full rights. According to him, the defendant did not pay him full convalescence pay, set aside missing pension deposits and deducted his salary for holidays. The plaintiff further claims that the defendant refused to return to him a mobile phone line that he had owned for many years, and that she violated his privacy by collecting call output and installing cameras. The plaintiff is seeking compensation for unlawful dismissal, full payment of convalescence pay, difference in pension deposits, restoration of the telephone line, and compensation for invasion of privacy.
The Defendant's Arguments (the Counter-Plaintiff)
The defendant claims that the plaintiff's dismissal was lawful and that it stemmed from his serious acts, which included theft of goods, the delivery of trade secrets to a competitor, and competitive activity in violation of the duty of trust. The defendant notes that the plaintiff confessed to acts of theft and that his activity caused her heavy damage. The defendant rejects the plaintiff's claims for various rights, and bases her rejection on the provisions of the law. In the counterclaim, the defendant claims that the plaintiff stole her trade secrets, including a list of customers and work methods, and transferred them to counter-defendant 2, thus causing her significant economic damages. The defendant is seeking damages in the amount of more than ILS 8 million.
The rest of the parties' arguments will be raised in the framework of the decision.
