- The combination of circumstances that was brought before me, including the fact that I was persuaded that the amount of the loan was not received for the purpose of bringing about the partnership between the parties, leads to the conclusion that in the matter of Mr. H.Z.'s loan, the plaintiff succeeded in pointing out that with regard to this loan, it is a loan that is a financial manipulation on the part of the defendant and therefore should not be recognized as a joint debt. Regarding the rest of the loans, I came to a different conclusion as detailed.
- Conclusion and Conclusion
- From the entirety of what has been said and brought in this judgment, the following summary picture of the situation emerges :
- The plaintiff's claim for the balance of resources with respect to the parties' apartment is accepted in the sense that the defendant is not entitled to be registered as the owner of half of the rights in the parties' apartment.
- The plaintiff's claim that the defendant must return money transferred to him as part of his marriage is rejected. This includes rejecting the plaintiff's argument that the defendant must repay bank loans alone. The defendant's activity in the bank account was a joint conduct that was not unusual.
- The plaintiff is obligated to act in accordance with the provisions of the actuary's opinion regarding the balance of the parties' resources, with the exception of the exclusion of Mr. H.Z.'s loan. The exclusion of this loan leads to the result that the amount of the loan given by Mr. H.Z. in the amount of ILS 190,000 must be subtracted, and therefore, for the purpose of balance, the plaintiff must transfer to the defendant the sum of ILS 151,1634 (instead of ILS 246,143).
- The payment that the plaintiff must transfer to the defendant will be made in accordance with the actuary's opinion, with only a linkage difference added to it from the date the opinion was drafted until the date of this judgment. The payment will be made within 30 days from today, otherwise interest and linkage differentials will be added from today until the actual full payment.
- In view of the acceptance of the claim, although not in full, the defendant will bear the plaintiff's expenses in the sum of ILS 15,000. The amount will be paid within 30 days from the day otherwise interest differentials and linkage will be added to it as required from today until the full payment is actually made.
