There was no proof of negligence or breach of statutory duty on the part of the defendant in relation to the plaintiffs.

In light of all of the above, the result is that The claim against the defendant is dismissed.

  1. After considering the manner in which the proceeding was conducted, the decision and the scope of the dispute, the plaintiffs will bear the expenses that were actually incurred, Together with attorney's fees in the amount of ILS 75,000, To be paid within 30 days, Otherwise, they will bear a shekel interest until the actual date of payment.
  2. Prior to the signing of the judgment, it is not possible to ignore plaintiff No. 2's attack in court. Attention is not drawn to the dignity of this panel, but to the dignity of the institution of the courts, which cannot tolerate the degrading conduct of a litigant, and certainly when that litigant is a veteran lawyer of standing.  There was room to consider deleting his pleadings - but due to the importance of the proceeding and the principles under examination, I found that I did not do so.  However, I have found it appropriate to comment that there is no room for these statements, and that the living will take it to heart.
