He did not enter into a deal with the financing parties. Nor did he enter into a deal with the apartment owners in the existing building or with new buyers of the developer's apartments.
He buys an apartment for himself. He makes his own financial considerations.
When construction goes wrong, the delay continues, and the independent buyer finds himself facing a broken trough. As Mrs. Sidi described well in the minutes of the meeting of July 20,2026, quoted above, I see no reason to lead him to a personal economic crisis.
The public considerations of the 80 financing entities were not reflected in the transaction from the outset. I have not heard that it was made clear to the purchasers - in our case, the Dekel and Sidi families - that they would not be able to exit the transaction even if the construction was delayed, and that they were bound by the opinion and will of the financing bodies and of other purchasers and apartment owners. The transaction was independent from the outset, and this is also the end of the transaction.
I would also like to note that the inconsistency between the date of the start of construction promised to the Dekel family (May 15,2022) and the date of the actual start of the work, as claimed in the case of the Sidi family (April 2023), also attests to the inherent problematic in relation to the date of completion of the project.
- With all due respect, my opinion is that there is room to pour broader content into the guarantee The Sale Law.
In my opinion, the very fact that a receiver has been appointed for the project demonstrates the problem faced by the new apartment buyers in the project.
Problems that may find expression in the significant financial distress that at least some of the buyers find themselves in. Those who are unable to bear the financial burden caused to them as a result of not receiving the apartment on time according to the contract, and who are forced to pay at the same time both a mortgage on the apartment they purchased and did not receive on time and rent on the apartment in which they live, until the completion of the project.
