The company's position:
- The company announced on July 14,2026 that after a receiver was appointed for the project, from that date onwards, all powers were transferred to him.
Therefore, the company left the decision on the application to the discretion of the court.
The position of the secured creditors, the receiver, the secured creditor on the surplus:
- The secured creditors, the secured creditor for the surpluses, and of course also the receiver who will be appointed to represent the secured creditors, oppose Dekel and Sidi's requests for the realization of the guarantees.
According to them, there is no reason to realize the guarantees when there is an expectation of completion of the project, when an outline for the completion of the project has been approved, when the implementation of the outline has begun, and according to them, there is an expectation that it will be completed by November 2027 at the latest.
- The secured creditors state in the application that it was initially supported by the affidavit of Mr. Ofer Nachman, which was replaced by an affidavit of Ms. Feldman Stickot, Director of the Credit Division in the field of accompaniment and construction in theClal Insurance Company Ltd."From secured creditor, that in fact this is a demand for the forfeiture of three guarantees Sale Law, in respect of the purchase of three apartments"10 The families of Dekel and Sidi.
The secured creditors add that they are working to settle the violations and promote the project. At first, they tried to do so outside the court, and when this was unsuccessful, they turned to the court and an order was issued to enforce the liens and appoint a receiver who worked to complete the project.
- The delivery date is the same in both contract systems - 36 months from the date of commencement of the works.
In paragraph 5 of Ms. Feldman-Stackot's affidavit, she notes the differences in the date of commencement of the works in the contracts of each of the two applicant families. In Dekel's case, the date of commencement of the works was set as May 15,2022, but in Sidi's case, a date was not defined, and therefore, according to her, it should be appointed from the date of the actual commencement of the works, April 2023.
- According to the affidavit on behalf of the secured creditor, since the receiver was appointed, the project was insured, an outline for the completion of the project was approved, which includes the provision of additional financing, a new and Fauchley execution agreement was signed between the receiver and the contractor executing the works to complete the works, and the execution of the works began.
According to the secured creditors, the approved outline was promoted efficiently and quickly, and there is a horizon for completing the apartments and handing them over to buyers, including those seeking forfeiture.
