Already in his first interrogation with the police, even before the defendant's version was hurled at him (according to which the deceased was fighting with him and not with the accused), Tawfiq did not try to beautify or diminish the deceased's part in what was happening at the washing machine, when he said that during the confrontation between the two he already understood that the incident could deteriorate into violence, so he turned to the deceased and spoke to him: "So Muhammad got angry and I said so that nothing would happen, and Muhammad gave me respect, and told me that I would turn to him (the defendant) and talk to him so that he would not do it. "
Similarly, Tawfiq described that the deceased had already "satisfied", left the washing machine in the direction of his home, but returned to it after the defendant continued to make noise with his car. Tawfiq did not hide that upon the deceased's return to the washing machine, the deceased became angry and jumped in the direction of the defendant, while he tried to separate the two. Tawfiq even saw fit to describe the situation as one in which the deceased tried to hit the defendant, "and I received the beatings instead of Ahmed..."
Tawfiq even described in detail the manner in which the deceased hit the defendant's car, "with his left hand, I push him into the car and he gives a blow..." He also described a unique detail in which he said that during the beating, the deceased had a watch "and it was released from his hand." To the police, he described the blow on the car as a "kapah".
Tawfiq's version (except for his reversal of the threat) was consistent, and despite the insignificant changes, the main points were expressed in his interrogation, in the confrontation, and in his testimony in court. His version is supported by corroborating evidence, and passes the tests of logic and common sense.
Thus, for example, there is no dispute that the defendant was the one who made a noise when he arrived at the wash, by pressing the gas pedal hard (according to him, he did not do so in defiance, but rather because the car had been parked for a long time). Similarly, there is no dispute that this made the deceased very angry. In this situation, one must wonder why the deceased would attack Tawfiq and not the defendant who started the whole fight, especially when the physical confrontation began after the defendant continued to make noise after the deceased left his home and returned to the washing as a result.
