In his cross-examination, the defendant was asked why the deceased would break the windshield of his car if he claimed that the argument was between the deceased and Tawfiq at all, and he replied: "But it violates his dignity because it breaks the windshield in the wash." The prosecutor made it difficult for the defendant to understand the connection between Tawfiq's honor and the breaking of the windshield of the Avensis. The defendant replied: "He made the argument because I pressed the pedal." The defendant added that Tawfiq told the deceased to leave the scene and expelled him "so that there would be no fight and the place would be closed" (p. 334). According to him, the deceased was looking for reasons to close the wash. He wasn't upset after they broke his Evansis windshield because whoever was there told him that they would fix it.
Then his brother Karim came and picked him up. He drove and Karam sat next to him "because he (i.e., Karim) can't be, because he got his license not long ago." He drove a Dodge and not an Avensis because they had to bring things home for an event that was supposed to take place. We were going to go to the supermarket.
This is how the defendant described what happened after he changed Karam and began to drive: "When we were at the intersection upstairs, we wanted to go and take a left, sorry to the right... So the deceased was close... close... so he approached me" (p. 319). In response to the question of when he first noticed the deceased, he answered, "At the entrance when I hit him and I saw" (p. 320). In his cross-examination, he clarified that he hit the deceased with the right side of the dodge (front right corner) while he himself was on the right side of the road (p. 352).
According to the defendant, after hitting the deceased, he went down to the intersection and stopped and did not know what to do, "and it was a very difficult thing for me. So Karim, my brother, said to me, 'Drive, drive... Drive, drive, ' as if to say. Yes. I went to the family of the deceased's family" (p. 320). According to him, it was an ordinary accident and he did not intend to murder the deceased.
