The defendant's claim regarding a mechanical failure in the brakes is a false claim that is fundamentally refuted by a series of evidence.
First, the Dodge was subjected to a brake test by Examiner Partush and these were found to be in good working order (which is sufficient to contradict the claim). Similarly, the examination of the vehicle's integrity by another examiner, Mr. Cohen, also testified that the vehicle's brakes were in good working order. Second, the defendant's continued drive after the ramming with the Dodge vehicle from the end of the street near the wash is documented by a security camera (P/9 and Viewing Report P/9(b)). Although this is documentation from a remote camera, it is clear that the Dodge vehicle stopped shortly before it reached the intersection (camera time 19:00, real time 18:41), including noticing the red brake light that was on. After stopping, the Dodge is recorded exiting while accelerating as it passes to the left of a vehicle that is also at the intersection. Third, the defendant himself confirms that before the accident the brakes worked "in general there was no problem". Fourth, after the accident his driving a Dodge vehicle a considerable distance to the Yatir Forest is not possible without brakes, especially since it is a winding road.
