The plaintiff's main arguments
Carrying out severe, threatening and inciting defamatory publications
On February 7,2023, the plaintiff was interviewed on the current affairs program presented by Ben Caspit and Yinon Magal, in which he expressed his unequivocal opinion against the judicial reform and warned of a civil war that would develop if the government continued to implement the reform (hereinafter: the "interview"). According to the plaintiff, similar warnings were also heard from members of the government, senior officials in the political and legal system, as well as from the President of the State.
On the same day, as part of the broadcast of the program "Sheva" on Channel 14, the defendant referred to the plaintiff's words and published three serious defamatory statements, which constitute defamation at the highest level, which constitute clear threats and incitement against the plaintiff.
The first statement attributed to the plaintiff and his son an intention to grab a weapon and shoot the defendant: "Langotsky what - your son is going to take a gun and shoot me... He's going to take a gun, what to kill in a civil war, unpleasant things happen... What will he take a grenade and throw at whom?"
The second statement called for the prosecutor's arrest: "Why aren't you arrested tonight with all your old age? I saw Yoav Telem arresting old grandmothers and bringing them to detention, why aren't you arrested tonight, who gave you this right to threaten me, I feel scared of you, you are a person who threatened me, my children, my family."
