Civil Case (Acre) 16052-06-20 Viper Security Ltd. v. Hurfeish Local Council - part 8

Considerations relating to the public purse or economic logic do not, in and of themselves, justify a deviation from the language of the agreement or the addition of charges that do not derive from it (Appeal Petition/Administrative Claim 1122/22 State of Israel, Israel Land Authority v.  Sub Management Entrepreneurship and Investments Ltd.  (January 1,2023)).

Since there is no explicit update mechanism in the agreement between the parties linking the agreed hourly rate to the amount of public indemnity, the amount of the funding actually received from the police does not impose on the defendant an excess financial liability beyond its original contractual obligation.

  1. Not only that, the plaintiff's claim that the defendant "enjoyed both worlds", by allegedly receiving increased police funding by 64% but actually paying according to past rates, was also claimed in vain, without support for evidence. It was even unequivocally contradicted from the financial data presented in the case.
  2. As it emerges from the certificate of the accountant Serchuk dated December 21,2022, which compiles the data from the years 2014 to 2021, the actual amount of funding received from the Israel Police was only 61% of the defendant's actual security expenses. This confirmation proves that the defendant did not receive any enrichment at the plaintiff's expense, but rather bore the balance of the costs from its public budget while absorbing a lack of money.

Conclusion

  1. Therefore, and in light of all of the above, I determine that the plaintiff has not been able to prove her claim and order the dismissal of the claim.

I order the plaintiff to pay the defendant legal expenses in the amount of ILS 3,000 and attorney's fees in the total amount of ILS 14,000, within 45 days from today.

The Secretariat will send the judgment to the parties' attorney.

Granted today, September 27,2026, in the absence of the parties.
