The court accepts the claim in part

  1. The court accepts the claim in part, so that the defendant is obligated to pay the plaintiffs the sum of ILS 350,310.05, and to this sum must be added a shekel interest from the date of the beginning of the delay in each apartment until the date of the actual payment.

Application for Split Remedies

  1. The plaintiffs petitioned in the statement of claim for splitting the remedies in such a way that they would be able to sue in the future for tort and/or contractual causes and/or in accordance with the provisions of the Sale of Apartments Law, since their damages with respect to inconsistencies and/or depreciation and/or defects and/or any other claim deriving from the provisions of the law and the agreement have not yet been consolidated. However, they did not petition for split remedies in their summaries and hence abandoned the request. In any event, the plaintiffs are entitled to sue for damages that have not yet been formulated at the time the claim was filed.

Discussion of expenses

  1. Taking into account that the court received about one-third of the amount of the claim, and the consent of the parties will make it no longer necessary to hear evidence, only the sum of ILS 35,000 in the plaintiffs' attorney's fees should be awarded accordingly, also taking into account the plaintiffs' conduct in this proceeding as detailed in the discussion of the various issues, such as the failure to attach the agreements to the statement of claim and the lack of a response to the defendant's claims, such as in the case of Mr. Segal. The defendants will pay the plaintiffs one-third of the court fees they paid, and the rest of the expenses, each party will bear its own expenses.

Conclusion

  1. The court obligates the defendant to pay the plaintiffs as follows:
  2. The sum of ILS 350,310.05, plus ILS interest from the date of the beginning of the delay in each apartment until the date of the actual payment.
  3. The plaintiffs' attorney's fees in the sum of ILS 35,000 and one-third of the fees paid by the plaintiffs, all together with shekel interest, from the date of the judgment until the date of the actual full payment.

Granted today, October 4,2026, in the absence of the parties.
