In light of all of the above, I found that the claim should be dismissed.
As to the expenses of the proceeding, despite the dismissal of the claim, I did not find that the plaintiff should be obligated to pay the expenses in favor of the defendant. This is against the background of my conclusion regarding the defendant's lack of good faith as detailed above.
The Secretariat will send a copy of the judgment to the parties, and will close the proceeding with the court records.
